Terms of Service

These Terms of Service (“Terms”) govern your use of the express courier and freight delivery services provided by BLS Express Australia Pty Ltd (ABN 94 702 153 026) of Perth, Western Australia (“BLS Express”, “we”, “us” or “our”). By requesting a quote, placing a booking, or using our services, you agree to be bound by these Terms.
1. Definitions
- Consignment means any parcel, package, pallet or item of freight accepted by us for carriage.
- Sender means the person or business that requests our services or tenders a Consignment to us.
- Receiver means the person or business nominated by the Sender to take delivery of a Consignment.
- Charges means the fees, surcharges and applicable GST payable for our services as quoted or confirmed at the time of booking.

2. Our Services
We provide express courier and freight delivery services, including same-day and scheduled deliveries, throughout Perth and surrounding areas of Western Australia. Service descriptions on our Website are indicative only. Exact service availability, collection windows and delivery timeframes for a particular Consignment will be confirmed at the time of booking.
3. Quotes and Bookings
- Quotes provided by us are estimates based on the information you supply, including item dimensions, weight, contents, and collection and delivery addresses. Quotes are valid for the period stated in the quote, or 7 days if no period is stated.
- A booking is accepted when we confirm it by email or other written means. These Terms form part of every booking.
- If the actual weight, dimensions or service requirements of a Consignment differ materially from the information you provided, we may adjust the Charges accordingly and will notify you of any adjustment.
4. Charges, Payment and GST
- All Charges are payable in Australian dollars within the payment period stated on your invoice (or, if none is stated, within 14 days of the invoice date).
- Prices stated as inclusive of GST include the Goods and Services Tax applicable under A New Tax System (Goods and Services Tax) Act 1999 (Cth). Where prices are stated as exclusive of GST, GST will be added at the applicable rate.
- Additional fees may apply for services such as after-hours or weekend delivery, re-delivery attempts where the Receiver is unavailable, address corrections, returns, waiting time, and remote or difficult-access locations. These fees will be disclosed before they are incurred wherever practicable.
- Overdue amounts may attract interest and reasonable recovery costs, to the extent permitted by law.
5. Sender Obligations
You warrant, as a continuing obligation, that at the time of collection:
- each Consignment is securely and appropriately packed, labelled and addressed so as to withstand normal handling and transit;
- you are the owner of the Consignment, or are authorised by the owner to send it;
- the description and declared details of the Consignment are accurate and complete;
- the Consignment does not contain any prohibited, dangerous or restricted goods declared or handled contrary to clause 6; and
- the Consignment and its carriage comply with all applicable Australian laws, including customs, quarantine and biosecurity requirements.
6. Prohibited and Restricted Goods
You must not send, and we will not accept, Consignments containing:
- dangerous goods of any class (including explosives, flammable liquids and gases, corrosives, oxidisers, toxic substances and lithium batteries not packed to applicable standards) except where accepted under a separate written agreement and handled in accordance with applicable dangerous goods legislation in Western Australia;
- illegal items, or items whose carriage would breach any Australian law;
- cash, negotiable instruments, precious metals and jewellery, unless expressly agreed in writing in advance;
- perishable or temperature-sensitive items, unless a suitable service is expressly agreed in advance;
- live animals, firearms, and human or animal remains.
If you tender a prohibited item, we may refuse, suspend, return or dispose of the Consignment at your cost, and you indemnify us against any loss, damage, fine or penalty arising from it.
7. Collection and Delivery
- We will use reasonable endeavours to collect and deliver within the agreed or indicative timeframes, but all times are estimates only and are not guaranteed unless expressly agreed in writing as a guaranteed service.
- Where the Receiver is unavailable, or access is unsafe or impractical, we may leave the Consignment in a reasonably safe location (where authorised), attempt re-delivery, or return the Consignment to the Sender. Re-delivery and return fees may apply.
- A signature by any person at the delivery address who appears to be authorised to receive the Consignment constitutes delivery.
8. Transit Times and Delays
Delivery timeframes may be affected by factors outside our reasonable control, including traffic, weather, road closures, public holidays, and the accuracy of the addresses provided. We will keep you informed of significant delays affecting your Consignment where we are aware of them.
9. Australian Consumer Law — Your Rights
Nothing in these Terms excludes, restricts or modifies any rights that you may have under the Australian Consumer Law (being Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For significant failures in the services, you may be entitled to cancel the contract or a refund for the price paid, and for any other reasonably foreseeable loss or damage. You may also be entitled to compensate you for any other reasonably foreseeable loss or damage.
Where permitted by law, and subject always to the preceding paragraph, our liability for any failure to comply with a consumer guarantee is limited, at our option, to supplying the services again or paying the cost of having the services supplied again.
10. Limitation of Liability
- To the fullest extent permitted by law, and except as set out in clause 9, we are not liable for any indirect, incidental or consequential loss, including loss of profits, loss of business or loss of opportunity, arising from the carriage of a Consignment.
- Where liability is accepted, it is limited (at our option) to re-performing the affected delivery, or to the lesser of the Charges paid for the affected Consignment or the value of the Consignment, unless a higher level of cover has been agreed in writing.
- We are not liable for loss or damage to the extent caused by your breach of these Terms, inadequate packaging, inaccurate addressing, or events beyond our reasonable control (see clause 12).
11. Claims
- Any claim for loss of, or damage to, a Consignment must be notified to us in writing at ceo@blsexpressaustralia.site within 48 hours of delivery (for damage) or within 7 days of the expected delivery date (for loss), together with supporting evidence such as photographs and the consignment reference.
- You must allow us a reasonable opportunity to inspect the Consignment and investigate the claim before disposing of any packaging or damaged goods.
- Submitting a claim does not admit liability on our part.
12. Force Majeure
We are not liable for any failure or delay in performing our obligations to the extent that it results from an event beyond our reasonable control, including natural disasters, extreme weather, industrial action, utility or communications failures, epidemics, and acts of government.
13. Privacy
We collect and handle personal information in accordance with our Privacy Policy. The Privacy Policy forms part of these Terms.
14. Suspension and Termination
We may suspend or refuse services, or terminate an agreement for ongoing or scheduled services, if you breach these Terms, fail to pay Charges when due, or tender Consignments that endanger our people, equipment or other customers' freight. You may terminate an ongoing service arrangement in accordance with its written terms. Termination does not affect accrued rights or obligations, including your obligation to pay for services already rendered.
15. Amendments to These Terms
We may update these Terms from time to time. The current version will always be published on this page with a revised "last updated" date. Material changes affecting existing bookings will be communicated to you before your next booking. Your continued use of our services after publication of updated Terms constitutes acceptance of those updates.
16. Governing Law
These Terms are governed by the laws of the State of Western Australia and the Commonwealth of Australia. The parties submit to the jurisdiction of the courts of Western Australia, without limiting any rights you may have to bring proceedings under the Australian Consumer Law in your own jurisdiction where permitted.
